The first trial is to inform you that we have obtained a first trial decision stating that the above three companies have infringed Mitsubishi Chemical’s patents.
Patent for red phosphor: (Chinese Patent No. ZL201110066517.7)
On January 23, 2015, we filed a patent in China regarding infringement of Intematix’s patent on red phosphor (shared by NIMS and NIMS).
In addition, a lawsuit seeking injunction for infringing acts such as production and sales of phosphor products and compensation for damages in China has been filed with the Shenzhen Municipal People’s Court.
Judgment: Shenzhen City Intermediate People’s Court
We accept Mitsubishi Chemical’s claims.
“Intematix decided to stop the infringement and order to pay damages totaling 2 million yuan (about 30 million yen) to the Company”.
China LED: the largest producer
China is the largest producer of LED packages.
The white LED package, which is the main application of red phosphors, boasts the largest production volume.
That China recognized the claim of Mitsubishi Chemical.
Winning judgment in China:
This victory judgment (which orders Intematix to injunction and compensation for damages) is very significant for the company, which has been actively investing and developing for many years.
This successful judgment is important not only for the phosphor industry but also for the entire white LED industry.
We believe that this will lead to the sound development and order maintenance of the phosphor and white LED industries.
Supreme Court ruling in Korea:
On December 20, 2011, Mitsubishi Chemical filed a patent infringement lawsuit against Intematix and its distributor in Korea based on the corresponding patent of this patent in Korea. On April 2, 2015, Intematix and its representative Store patent infringement is allowed.
In Korea, we received the “judgment ordering the suspension of import and sales of phosphor products manufactured by Intematix in Korea”.
